Risky creative patterns

  • Anyone who is or looks under 25 shown drinking or in a significant role (CAP 18.16). Under 25s allowed only incidentally and 'obviously not drinking'.
  • Media with more than 25% under-18 audience (UK, CAP 18.15). US spirits code: placements need at least 73.8% of the audience aged 21+ (raised from 71.6% in May 2023).
  • Influencers popular with under-18s, or influencer posts not labelled as ads (Muff Liquor/Laura Whitmore).
  • Drinking amounts escalating with energy or mood (the Muff Liquor 'drink by drink' dance).
  • Reposted UGC on brand Instagram stories counts as the brand's ad (White Claw 'Wavemakers').
  • Non-alcoholic ads that show alcohol must follow the responsible-drinking rules (CAP 18.18, from 14 May 2024). On Meta, a zero-alcohol ad that depicts alcohol becomes an alcohol ad.
